The ABC broadcasts more lies

You’ve just got to wonder how much quality control $1.2 billion actually buys.

Fresh from reporting that Australian naval personnel were torturing alleged asylum seekers and broadcasting a photoshopped picture of Chris Kenny molesting a dog (not to mention sacking Glenn Milne as part of a political cover-up) the ABC has broadcast pure fabrication.

MARCIA LANGTON: Well, this Bolt case is being depicted now as if it were a matter of high politics. In my opinion, the articles that Bolt wrote about several Aboriginal people were far from the subject of politics and simply abusive. Now, just to take one instance, there was a young woman who was the victim of his abuse and she is now a world renowned immunologist, Dr Misty Jenkins. Now, she is very fair-skinned, like my children, and I’ve known her since she was a young science student at the University of Melbourne. She later went on to do a PhD under Professor Peter Doherty. Then she went to Oxford and Cambridge and she has worked hard all of her life and she is a dedicated scientist. Has never particularly benefitted from her identity as an Aboriginal person. She has more than earned her way in life on the merits of her work and yet she was the victim of foul abuse from Bolt and she, as a result of that case, withdrew from public life. She used to speak to students. Now, nothing that he said about her was political. It was simply racial abuse. He argued that she had no right to claim that she was Aboriginal and, like most fools who put this argument in public, we are expected to deny our parents and our grandparents because somebody believes in race theories.

How do we know it is a pure fabrication?

Page four has a feature on Dr Misty Jenkins, a blonde and pale science PhD who calls herself Aboriginal and enthuses: “I was able to watch the coverage of Kevin Rudd’s (sorry) speech with tears rolling down my cheeks . . . Recognition of the atrocities caused by Australian government policies was well overdue.”

A quick search of the Eatock v Bolt judgement (pdf) finds no mention of Dr Jenkins.

Marcia Langton has defamed Andrew Bolt. Now he is of the opinion that defamation is a restriction on free speech – so he won’t sue. The consequence being that he will always be vilified as a racist. Not only is it a cheap shot for the Left, it is a free shot.

I suspect the ABC won’t issue a correction or even mark in the transcript that the facts of Langton’s statement are in dispute (they have done that only once, that I’m aware of, when John Roskam quoted Phil Jones as claiming that there was no statistically significant warming since 1995).

    The judgement aside, if Andrew Bolt made no mention of Jenkins in the articles in question – and it is now forbidden by law to check for our little selves because the political class have deemed us too stupid to work things out ourselves – then he should sue Langton for defamation and demand an apology from the ABC if they don’t clarify the matter during the next episode of BandS.

    The reason that people like Langton have gotten away with this vicious tripe for so long is that no-one has had the intestinal fortitude to really take them on. I am not blaming Bolt as an individual – he has a family to feed and a heavy workload. But it just keeps happening, over and over again.

    It would be delicious if Langton took The Australian to court. I rather suspect that they would not be as much of a pushover as those who have been intimidated into silence in the past.

    I saw once a suggestion that peoples race be credited to them as transferrable right. Set the numbers once, and from there on children inherit both their parents actual genetics, and the birthrights that their parents own.

    You want the societal advantages that comes with being recognised by law as an Aboriginal, well you can trade your birthright for an Aboriginal one at the going market rate.

    It would appear that Dr Misty Jenkins fits within the class of people recognised by the judge in the case. It would also appear it’s Sinclar Davidson who is broadcasting lies and needs more quality control.

    Wilkinson showed that she is as much of a coward as her husband by joining in and building a mob attack without ensuring any of the details were correct. The Prima Donna knows Channel 9 will not stand up to her. Pity, they could switch that nasty partisan out with another person and that morning show will attract viewers.

    Jerry Springer Jones is the worst of the lot as he set up the prepared question, and then did not stop / divert the conversation as Langton & Wilkinson defamed Bolt.

    I think this is relevant too. What’s the point in looking for a retraction/apology/note within a transcript, if a more blatant form of deliberate discrimination has occurred right in front of us? I don’t think that Wilkinson’s comments should go unchallenged by commentators in general, either.

    It’s a ball, once started rolling is expensive to keep rolling until you win.
    And by win I don’t mean one dollar in damages with no reference to costs, but rather the sort of damages only a Supreme Court can award, costs and a public apology which really would see a withdrawal from public life.

    Neither Kenny nor Bolt should have even had to consider suing the frigging ALPBC, because:

    A) The attacks should never have been broadcast in the first place
    B) Immediate steps should have been taken to discipline the morons responsible for the broadcasts and a very prominent, unequivocal apology issued ASAP by the ALPBC

    Ultimately, attacking Bolt for not pursuing a defamation action is not the issue here.

    The vitriol heaped onto A Bolt on Q&A is clearly in breach of the ABC’s own policies. Sack Jones. Sack the Q&A producers. Sack Scott. Use the Commission of Audit to springboard a massive reduction in the ABC’s budget.

If the ABC was required to note “the facts are in dispute” when someone disagrees with a comment they would be doing nothing else but that. I think most of the “facts are in dispute” in relation to most of the utterances of the PM but should the ABC make a note of it? Its called reporting comment.     Why should the ABC issue a retraction because a guest on QandA says something that may not be accurate?
    That used to be called “Shooting the messenger” – which is what the reporting of the alleged abuse of asylum seekers was all about.
    If they were to do this for every person interviewed, participating in a panel, or having comments reported, they’d be doing nothing else.
    It’s pretty clear to me that the issue is not accuracy, but partisanship.
    If her comments were supportive of Bolt, we’d be hearing nothing.
    It’s the usual boring as batshit binary bullshit………..

    If I was aboriginal I would be making a complaing about that man and the program for the way Springer Jones used Ms Langton in the knowledge she would make statements which would put the ABC in high risk of defending a defamation case.

    I asked for a retraction of her statement and an apology. I am still waiting for the dignity of a reply. Somehow, I imagine one will not be forthcoming. I am more than happy to prove my heritage and stand behind what I say, funnily, Ms Cole is not at all interested in opening a dialogue. She wields power in the community, being that she is part of a fast growing group of coddled and entitled White Aborigines who have found favour with other White Skinned Aboriginies in important Indigenous Identified positions throughout Bureaucratic Australia.

    So, this blog is my outlet, to share my encounters with people like Ms Cole, and all the other people who use Aboriginality as a way to further their careers, whilst exploiting the very people they claim to represent.     Might be hard to arrange these days, but the disadvantage inherent in being genetically Aboriginal in a modern environment could be reasonably well established by research. Mind you, it was probably done properly back in the 1930′s, before eugenics became a forbidden research field due to its association with the losing side in WWII. If anyone cared to look it up it would still be valid; these things don’t change over time.

    These days, with genetic testing, you could probably tie a good chunk of that disadvantage to specific alleles rather than simply race, removing some of the variance.

    Using American Indian’s would not be appropriate, as their genetic makeup is vastly different to Australian Aborigines.

    Once that was done, given that you want to address ‘the inequality’ in some fashion, you could quite simply evaluate any individual for the amount of support due.

    But hey, statistics are racist.

    In regard to a white person being abused based upon their skin colour, there is only one relevant decision, the Federal Magistrates’ Court decision of McLeod v Power [2003] FMCA 2.

    The judge held at [54]:
    The purpose of the RDA and the Racial Hatred Act in particular is to prevent racial discrimination and to implement Australia’s obligations pursuant to the ICERD. One of the central elements of racism is a belief in the superiority of one race, religious or ethnic group over another. In states or countries where racist beliefs or policies hold sway, minority groups are at particular risk from the implementation of policies based on such principles and may be damaged by the prejudices that flow from such attitudes. It was to protect such minorities that the RDA was implemented.

    And at [55]:
    Section 18C of the RDA speaks of “race, colour, or national or ethnic origins”. In my view the term “white” does not itself encompass a specific race or national or ethnic group. It is too wide a term for that. “White” is of course a colour. The Australian Oxford Dictionary (1999) gives as one of the meanings of “white” the following: “of the human group having light-coloured skin”. Using this definition the majority of the Australian population can be described as being “white” and certainly people with “light-coloured skin” constitute the dominant group in Australian public life.

    Well the ABC has commissioned two independent audits from journalists which exonerate the abc of any bias.
    Maybe i am too cynical but, it is my view that these audits are whitewash. I find it difficult to accept that a report is independent when it is commissioned and paid for by the abc, on the abc. Not good enough for me . They will have to do better than that.

It is reasonable to assess what a person says according to ordinary patterns of speech. (For what it’s worth, this is how the law of defamation works, A totally accidental defamation is actionable; some lawyers may recall the famous case of Artemis Jones). In other words, I do not think it can be fairly said that Langton was lying when she attacked Bolt over his comments about Misty Jenkins.

    Now, JC. I had resolved not to respond to you, but calling me ‘useless’ is mild abuse. Indeed, Mrs Rafiki often calls me that, in particular when I spend time on the Cat. My point is this. Until very recent times, a pale face who was known in a community, or a school, or workplace, etc to have Aboriginal relations would in all likelihood at some stage – or many stages – have been called an “Abo”and ridiculed (or worse). I feel that Bolt does not appreciate this (taking a generous view). I have not be one to ‘bend over blackwards’ and my career suffered because I would not yield to pressure to pass an Aboriginal identifier. But I try to avoid any suggestion – however remote it might be seen on the face of it – that a person should not claim their Aboriginal ancestry.

Bolt was articulating that on a basis of need these people were less likely to need grants and scholarships that would have been better placed to help remote and poor aborigines; not just because of their paleness, but also their often better housed, well fed, cashed up urban lives.

    As Black Steam Train said to a pale aborigine on ABC one night (the one Bess was on) to paraphrase – you might think you are black mate, but when we walk out of here you will catch a taxi no worries – meaning that because Black Steam Train is black, taxi is less likely to pick him up. (I know which I’d rather have in my car) Now Bess Price and Alison Anderson both argue that help must be needs based, not race based and that is what Andrew was trying to say.

    Both Black Steam Train and Andrew wonder if the gravy train wasn’t there, if quite so many people would identify as aboriginal – or at least, the identification would then be real, with no fiscal inducements.

    Unfortunately this whole thing has descended into a he said she said therefore racist meme, which is disappointing, because the loud left get to shut down debate again, a debate which needs to be had.

    The experience of going through the courts, is difficult to truly understand unless you’ve been through it.
    Personally I have not, but my parents have been sued for unfair dismissal and subsequent workcover claim. I saw my dad be put on the stand and attacked in such a horrible, personal way. It shook him for a long long time. His case wasn’t front page of the Herald Sun or featured on the evening news. But I cant imagine how he and my mum would have gotten through it if it were.
    Until you’ve walked a mile in someone else’s shoes…
