The debate on press regulation continues

Earlier this year the Melbourne University Law Review published a paper by Ray Finkelstein and Rod Tiffen setting out a defence of the Finkelstein Review and its recommendations.

Chris Berg and I have written a reply that can be downloaded from the Social Science Research Network.

In this paper we provide a critique of the Finkelstein and Tiffen argument for increased regulation of the press. By failing to incorporate recent advances in the economics of regulation into their argument they fail to provide a coherent and rigorous foundation for their position. This leads them to overlook more obvious policy solutions to the problems they perceive in regulating the press. The Finkelstein and Tiffen paper also neglects to incorporate the political context underlying press regulation in general, and the Finkelstein Inquiry in particular. By underplaying the importance of both the economics of regulation and the politics of press regulation the Finkelstein and Tiffen paper misdiagnoses the problem under consideration and leads to inappropriate policy advice.

    Fight the battle the best way you can, but don’t be surprised at the outcome when you take on a Terminator with a pea shooter. What we need is Judge Dredd.

    You want to regulate the press?
    Simple, allow the general public to sue whenever the press publishes a lie or falsehood. Defence to be proof that the assertion is true and not by hearsay evidence.

    Putin turns out to be a great fan of Ray Finkelstein, he especially liked the enforced registration of bloggers. Really keeps opinions under control.

    The argument in their regulation, “because we need smarter people (i.e. us) to lord over you, and because progressive values (such as breaking monopolies) aren’t enacted quickly enough by the market”

    Sinclair’s paper references Professor Mark Pearson’s thoughts on the whole issue:
    “The Media Regulation Debate In Democracy Lacking a Free Expression Guarantee.”

    It is important to follow up the references on Sinclair’s paper.

    Freedom of expression is important to ALL Australians.

    I demand more murders by heads of state, more press regulation, more money spent on welfare for migrants and to severely reduce the migration quota each year which clearly has NO ECONOMIC BENEFIT!!!
