    Seems the Setka charges related to OCT and then the few days after the Boxing Day incident but not anything that happened on Boxing Day itself. I can understand the wife not wishing to give evidence against him but surely the officers who attended the scene have enough evidence from what they saw and heard. Plus at that time he was in breach of an AVO.

    One might almost think the police have done their best to help him out.

    I’ve heard of lawyers who tell distraught people going through divorce yeah yeah ring me anytime blah blah and so they do without realising that every phone call, every photocopy n every email cost them money and then they end up bankrupt trying to pay the bloody lawyers bill afterwards. I just think the family court should be blown up really figuratively speaking of course. I hope Gough Whitlam is frying in hell for the destruction he wrote on this country and on many families with his ghastly ghastly family court and divorce laws.

    Any person who truly feels unable to accept those conditions should either not accept an offer of employment or if already part of the organisation, then they should consider resigning in order to find a place of employment better aligned with their moral compass.

Once again I go back to that young guy at a seal he also noted that even if it progresses in the courts the high courts in the High Court could opt to just rule on the case and not provide any general principle which is what they have done before. But there is that free speech case in the high court now with that public servant whose name I keep forgetting but I think Des Deskperson remembers it. Oh wait I want to remember her Twitter handle I should be able to find it.

More recently, renowned ‘honest skeptical empiricist’ Dawkins claimed that Aquinas, for instance, never showed how you get from the cosmological argument’s Unmoved Mover to the other divine atrributes like simplicity, omnipotence, good, timeless, etc. even though Aquinas spends almost 300 pages in the Summa Theologiae alone on just those arguments.

    For a start, the whole point about being anti discrimination is that there are certain things that a person cannot change. People shouldn’t be discriminated against for those things. Religion can be changed. Therefore religion doesn’t belong in the list.

    I guess we can take sex discrimination off the list as well, as that seems relatively easy to change now.

    I don’t see myself as required to thoroughly go through every available argument from every possible alternative philosophy, even if it was practical to do so, which it obviously isn’t.

    If there can be one “Unmoved Mover” then logically speaking there’s no limit to how many others might be out there. That’s one of the most basic principles of empiricism: if we do a test in this place at this time and discover something like gravity for example … then we don’t need to do the same test in all places at all times to be confident that gravity will continue working. It is empirically impossible to PROVE that the sun will rise tomorrow, but based on a long history we presume there is good reason for the sequence to continue, even absent of any concrete proof. Hence, a process that is primarily inductive but willing to use deductive tools from time to time where that helps.

    I received a notification this morning from Dutton Cars advising that Victorian Stamp Duty on luxury vehicles will increase from July 1st. (This tax applies in addition to the Federal LCT surcharge that starts from a miserable $67,525).

    For vehicles valued greater than $150k, the amount of State tax will double! By example, a car costing $160,000 will see an additional Victorian tax impost of $7,680 bringing the total State Stamp Duty to $14,400. For those spending $200k, you will need to find almost another $10,000 in additional cash to pay the tax.

    Is there such a thing as a tax that Government’s don’t like? (rhetorical)

    One interesting item in the notification was that low emission vehicles will not have any tax increase.

    Some Cats may recall my comments of a few months ago when there was debate about electric vehicles on this blog. At the time I commented that punitive taxes will be applied to ICE cars to promote the take-up of electric vehicles. I am not saying that the Victorian Government are that far ahead of the curve now……but this is a demonstration of how it will work.

    Except, when the time comes, cars under the LCT will be charged an ‘environmental surcharge’ or something equally banal.

    In Flowers v. Mississippi, Kavanaugh wrote a 7-2 majority opinion overturning a sixth conviction of a cold-blooded murderer who was convicted of killing four people 23 years ago. Although he was convicted with evidence beyond a shadow of a doubt, in Kavanagh’s view the jury pool was racist. Overturning state due process: This is yet another example of the growing trend of the federal courts taking over state criminal law procedures and according the worst criminals a degree of process that would confound our Founders. And it’s most often because of racial politics.

    Confirming that we never should have taken this case, the Court almost entirely ignores—and certainly does not refute—the race-neutral reasons given by the State for striking Wright and four other black prospective jurors. Two of these prospective jurors knew Flowers’ family and had been sued by Tardy Furniture—the family business of one of the victims and also of one of the trial witnesses. One refused to consider the death penalty and apparently lied about working side-by-side with Flowers’ sister. One was related to Flowers and lied about her opinion of the death penalty to try to get out of jury duty. And one said that because she worked with two of Flowers’ family members, she might favor him and would not consider only the evidence presented. The state courts’ findings that these strikes were not based on race are the opposite of clearly erroneous; they are clearly correct.

    In Thomas’ view, “Today’s decision distorts the record of this case, eviscerates our standard of review, and vacates four murder convictions because the State struck a juror who would have been stricken by any competent attorney.”

    Australian corporates had “really crossed the line” in the Israel Folau furore, shunning people for their religious beliefs while playing the “moral arbiter of socially acceptable thinking”, according to Jeremy Sammut, a senior researc­h fellow with the Centre for Independent Studies.

    Dr Sammut’s comments follow the censure of Folau’s netball star wife Maria, by two key women’s netball sponsors, ANZ and health insurance company HCF.

    Over the past 24 hours both sponsors have reportedly told Netball Australia they were unhappy with Maria Folau’s decision on Friday to repost a link to her husband’s now defunct GoFundMe page.

    HCF told Netball Australia there was an urgent need for “a strong, clear and well enforced social media policy and education amongst its players and staff”.

    HCF told Nine Media on Wednesday: “We appreciate the complexities of the Folau matter and acknowledge that views do differ in the community, however, we do not support Maria Folau’s stance on this matter.”

    “There is no place in our society for discrimination of any kind, including on the basis of gender, religious belief, age, race or sexual orientation.”

    Dr Sammut said the extraordinary community backlash caused by GoFundMe’s decision take down Folau’s funding appeal page on Monday demonstrated what a “tin ear” the big business had when it came to the feelings of ordinary Australians.

    “It looks like the community thinks the big end of town has decided to mob up, endlessly posturing about their “right on” politics,” he said.

    “Corporates live in a corporate bubble and they have clearly crossed the line in relation to Folau. They are clearly getting into the business of social engineering, making decisions on behalf of the community about what views are socially unacceptable.”

    He said the Folau saga had been sparked by Rugby Australia and its major sponsor Qantas seeking to punish the former Wallaby for his fundamentalist Christian views while holding themselves out as a beacon of “progressive ideology and identity politics”

    ANZ and HCF, he said, were now climbing on board to chastise Folau’s wife, a star shooter with the Adelaide Thunderbirds, for supporting her husband.

    “’I am amazed that HCF and ANZ have doubled down on the same approach given the negative backlash against GoFundMe’s actions,” he said.

    ‘This is much more dangerous than just corporate virtue signalling. It amounts to an attack on fundamental freedoms in a democratic society, including religious freedom.”

    That’s kind of where most Atheists give up, because there’s some walls out there not worth endlessly banging your head on. If the universe contains highly privileged frames of reference then there needs to be a really well demonstrated reason for that, and in empirical terms that means some good experiments that locate at least one privileged frame of reference. Do that first … then come back. There’s no way I’m dealing with 300 pages of Aquinas.

    Only in the Territory Department:

    An overloaded utility with 33 passengers crammed into the tray has dumbfounded police in the Northern Territory.

    The car was driving between remote communities when it was pulled over at a vehicle inspection point near Palumpa, 360km south-west of Darwin.

    Bodycam footage, obtained exclusively by 9NEWS, shows the group sitting patiently in the tray, as an officer climbs onto the police car to count heads and another speaks to the driver.

    Constable Tyrone Smithers described the case as “quite shocking” and said there were both adults and children, including babies, in the tray.

    Speedbox – as I just said on the other thread, no one not even Izzy would know who donated and why. For example even if he knew a name he would not know what job they had or what their income was or whether they were a Christian or not or what motivated them to donate. They could have just been pissed off at rugby Australia for destroying the competition, they may have been a Christian who thinks their own freedom is under threat, they may have been someone who just got fed up with political correctness and corporate bullying, or somebody who thinks it’s grossly unfair that you should be sacked for posting something on Instagram. We don’t know.

    I know that the lefties have already been demanding that ACL devulge details of the donors and their demographics but this is not a charity donation and all I still has to do is fulfill their normal legal and tax obligations as administers of the trust fund. I think people may not realise that they actually have a legal arm which is not a charity. They are not running is is legal defence but simply providing the trust fund services. There is absolutely nothing wrong with it that I can see because I have contributed to other legal defence farms which are run through lawyers trust accounts.
    They’re absolutely pissed off even that maybe some big donors are backing him or perhaps big interests overseas are backing him. Too bad this is a private legal defence. It is not a political campaign or a lobbying campaign so anyone can donate. Of course all this does not concern them when overseas organisations fund Actual political campaigns who or attempt to influence our laws. For example we already know about get up operating under more or less. Re tenses and we certainly have had other so-called charity groups actually received tax dollars not tax breaks but actually get taxed dollars while engaging in non-charitable activities. The Australian conservation foundation would have to be top of the list but most green and Climate Change groups are certainly dodgy in that regard. I’m happy even to have a whole royal commission on that lot.

    haha I just read an article from a couple of months ago by Jacqueline Maley at the s m h. after she visited Morrison’s church for a Sunday night service. It was actually not a bad article but it had a killer line from some dude who said pentecostalism is the perfect Christian faith for a conviction politician with no conviction. It’s suggested to that the Pentecostals have moved away a bit from the prosperity gospel so that still around and there is any number of them softening on homosexual activity. I then looked at Izzy’s twitter it really is harmless and quite mild but there are a couple of really fun interesting tweets. For example in one he says that any preacher who doesn’t preach repentance is a false teacher and there’s another one where he has a go at Brian Houston of Hills on fame and that may have been around the time Brian Houston Connor said Izzy was wrong. Anyway the more I poke around the more I really like Izzy. Maybe I haven’t given him enough credit.

    The only question is whether they force the Vicar to carry this stinking can to the end, or whether they cut her loose now. They can’t fight this to the end now. Even if they win the case, the game will be destroyed.

    Yeah, this is now in the existential threat realm. Folau has a huge war chest (another $32k in the past 30 minutes) and a strong probability he will achieve the $3m in a few days. So they need to think carefully. Sue for peace? Or go for broke (which is an actual possibility). What about Qantas? Will Joyce accept anything other than Folau’s extinction from the game in Australia? The Qantas deal expires at the end of 2020 and is worth $4m a year. What is Qantas walk away and say “sue me”.

    RA have created a f*cking mess and compounded their management stupidity by acquiescing to Qantas (and being seen to do so).

    They have to know that probably 25-30,000+ people have donated so far, and continue to do so. I don’t see how they can walk it back without a humiliating loss of face that will undermine the sport for years. Dismissing the CEO alone is not enough – most of the Board would have to go. Bring in an Administrator – “oh God, is there no end to this disgrace!” (see my use of God there? 🙂

    Right now, I’m not sure what the solution for RA would be.

The majority of the public, most of whom watch the usual TV news and morning shows/The Panel etc, read the daily printed communiques, or click on the Yahoo ‘news’ items when checking their email, are none the wiser about the deeper issues. Outside of our echo chamber here, I would bet that very few know what is at stake, or would even be interested if they did know. If Folau wins in court – we won’t hear of it. The enemy has far more resources than us, is willing to do more than us, and has greater experience than we do in standing and fighting for something.     In 2018 Israel Folau (the player) made a homophobic comment on Instagram. He was apparently counselled and warned against making further such comments by his employer, the ARU, but not disciplined.

    In 2019 Israel Folau made a further homophobic comment. On review by a panel of 3 investigators as provided for in the ARU Code of Conduct, Folau was found to have made a high level breach of the ARU Code of Conduct and his employment contract was terminated.

    On the face the termination seems to have been grounded on breaches of at least the following sections of the Code that apply to Players:

    1.6 Do not make any public comment that is critical of the performance of a match official, player, team official, coach or employee/officer/volunteer of any club or a Union; or on any matter that is, or is likely to be, the subject of an investigation or disciplinary process; or otherwise make any public comment that would likely be detrimental to the best interests, image and welfare of the Game, a team, a club, a competition or Union.
    1.7 Use Social Media appropriately. By all means share your positive experiences of Rugby but do not use Social Media as a means to breach any of the expectations and requirements of you as a player contained in this Code or in any Union, club or competition rules and regulations.
    1.8 Do not otherwise act in a way that may adversely affect or reflect on, or bring you, your team, club, Rugby Body or Rugby into disrepute or discredit. If you commit a criminal offence, this is likely to adversely reflect on you and your team, club, Rugby Body and Rugby.

    Neither the 2018 comment nor the 2019 comment is a quotation from the Bible. The inclusion of other categories of person in the 2019 comment does not lessen its homophobic nature or intent.

    Folau has previously said that he is prepared to walk away from rugby and his actions have now engineered that result. This coming Friday’s meeting with the ARU is likely to show him how little they will pay him to do so.

    Well, hasn’t it been an incredible 48 hours. Over two million dolars in two days, and still growing strongly. I think the kraken of true public opinion has been well and truly awakened, and I don’t think they will be able to put the lid back on it any time soon.

    I wonder how long it’s going to take for our PC media and politicians to wake up to the fact that this reaction has very little to do with religion, and a whole lot to do with a general population fed up to the back teeth with being told how they are supposed to think.
