    Are they plain clothes detectives?

Imagine going through police training. I wonder if they ever thought they would be enforcing such “laws”.

“They were ordered to do it” no doubt their excuse.

  2. This is backwards.

We are worse off than we were before the Eureka Stockade.

  3. mh

    Oh my fucking Lord.

If Vic Cats aren’t protesting alongside Sam Newman this Saturday, they should hang their heads in shame.

  4. notafan

Lefties really love punishing their enemies. In a few years are they going to shutdown unapproved Climate deniers?

Hopefully the Chook up here doesn’t get any ideas!

  8. Elizabeth (Lizzie) Beare

This is outrageous. It is sheer Stasi techniques. This woman is pregnant and distressed. She has a right to complain about lockdown and the effect on her family. If others want to march that is their business not hers.

Get that boot off that pregnant woman’s baby!

  9. Entropy

A boot stomping on an unborn baby’s face, forever.

  10. Tim Neilson

    Just for the record,
Iamashiteater is the most pretentious conceited stupid ignorant self-beclowner ever to humiliate himself on this site.
He loves using technical terms from philosophy to make himself look clever, but always misuses them calamitously, thus revealing his utterly hopeless intellectual ineptitude.
For example on the 27/8/20 “What did Ronny say Josh?” thread he described citing Court decisions as evidence of Australian law as “appeal to authority logical fallacies”.
Yes, he really is that much of a sad sack risible contemptible pretentious loser and failure. What a turd!

  11. They’ve gotten all Butch with a caucasian chick in the suburbs of Ballarat.
Anybody got a link to the arrests made in the kitchens of Dandenong on ethnic Albanians?
    … anybody?

  12. Tim Neilson

Poor old conceited stupid ignorant Iamashiteater.

Yes, we definitely think people shouldn’t just be able to break and enter into your house, or any other property that you own – whether you own it individually, or jointly whether in individual names or through an artificial legal entity.
That’s why we’re supportive of sovereign states having the power to control their borders.

“Daily Mail” were running this story, and allowing comments. They’ve suddenly gone down the memory hole….

  14. nb

Today I saw ten police vehicles rushing to something or other. I thought to my self ‘Facebook post’ as a kind of macabre joke. Macabre, yes, joke no.
    Dan the boy, all heil.

    Is this Australia?

    God help us!

  16. nb

I am unsure why potential protesters don’t include a few BLM slogans. Free pass.

  17. Snoopy

Just as well plod had the foresight to take along the morbidly obese midget wearing the pink hoodie. Things could have become a bit willing without her commanding presence.

  18. The officer named on the warrant is not the officer who attended & made the arrest.

Is that sop in the VicReich stasi?

  19. Entropy

So glad I don’t live in Victoria.

The worst aspect about this for those of us living elsewhere is that these lefty nazis will give other States Governments ideas in the short term, and in the long term there will be mass migration of Victorians to where we are, where they will vote for pricks like Ghengis Dan.

  20. Entropy

Just as well plod had the foresight to take along the morbidly obese midget wearing the pink hoodie.

Even the pregnant woman could have outrun that. Maybe a social “worker”?

Angry Alan Jones backs up Zoe Lee

Radio king-turned Sky News pundit Alan Jones was so enraged by seeing the video of Ms Lee’s arrest that he called on Victorian Premier Daniel Jones to resign.

He posted this rant to his Facebook page after seeing the video after Daily Mail Australia was the first to publish it.

    DANIEL ANDREWS SHOULD RESIGN TONIGHT

Thankfully I am not the only Australian who thinks this is appalling, disgusting and disgraceful.

A pregnant woman, forced into tears, handcuffed in her pyjamas, in front of her children, I think it is in Ballarat, for ‘incitement’.

The only person guilty of incitement is the Premier of Victoria.

His outlandish grab for power, his disdain of any accountability is forcing people to behaviour simply designed to take back their freedom.

This woman is a victim of the appalling and unlimited powers given to the Victorian police.

Everyone knew it would come to this. You can only push people so far.

Wherein lies the violence in what you see here? The violence towards a pregnant mother is the like of which no Australian will tolerate.

Go Daniel Andrews and go now before more damage is done.

    Daily Mail.

  23. mh

Which Coalition Fed politicians will stand up and condemn what is happening in Australia’s reddest State?

    Any of them?

  24. C.L.

One of those situations where violence against police is fully justified.

Ordinarily I’d predict they’d pay their mortgage off with the settlement.

I’m sure scomo will get tough and say something like:

This not a federal issue it is a matter for the state of Viktoria to resolve.

  31. Muaddib

The police rely on the consent of the governed and ‘popular support’ if you will to carry out our duties effectively. VicPol will need to spend years recovering public trust.
Have these clowns consciously thought beyond stage one as Thomas Sowell would say…Searching someone’s home, seizing private property for a speech violation (incitement?!) and then arresting them, Soviet Union ring any bells lads?
The long-term consequences for VicPol will be quite damaging. As a fellow LEO I watch with profound dismay at the train-wreck headed their way in the years to come.

When you think the behaviour of the Victorian police have reached the depths of depravity they pull another stazi trick out of their hats. The Human Rights of an entire state is under siege by Dan Andrews and his equally despicable comrades who voted in a state of emergency that now has the unmistakable imprint of the USSR ,CCP and East Germany under communism.

  60. Delta A

You have to feel for the brave officers* who gallantly trooped off to arrest a riot-inciting, bogan troublemaker, only to find themselves facing a cute little mum-to-be in her pink flannelette pj’s.

    Oops!

But they boldly blustered on, making the kind of headlines that will resonate around the world.

    *Nah. Not in the least.

  61. Rockdoctor

Wow, they obviously don’t give s&*# about risk to reputation anymore. I’d say the rank and file are enjoying the power trip as well. Saw some upthread reference Eureka Stockade, don’t think it will be that dramatic but sooner or later some of the plod on the beat are going to be ambushed by larger numbers than they can muster with the perps disappearing into the woodwork or we will see a Macquarie Fields episode in one of similar minded suburbs that ring Melbournes fringe…

Now back to reputation, this will be the biggest consequence of this. That will take a generation or more to repair barring any repeat behaviour.

  62. Spurgeon Monkfish III

Wow, they obviously don’t give s&*# about risk to reputation anymore.

After Gobbo X and Get Pell, that’s entirely unsurprising.

I am still scarred by the lefty philosophy weirdo who taught jurisprudence vascan adjunct.

*Cooke!*, he said, yet wrote Coke…

I’ll say it again guys, if you live in Victoria, watch your digital hygiene. I wasn’t joking, then, or now.

You cannot fight, or even support the fight if you allow the VicStasi to pick you off as an individual. One obvious solution for those in Victoria who want to organise protests is organise protests from “Free Australia”, ie; outside the Victorian jurisdiction. Ask a friend or set up decoy accounts.

As for the actions of VICPOL in this instance, fucking disgraceful.

    ‘trained-to-issue-summonses-rather-than-arrest’

This is a good point. There’s nothing in legislation to prevent them arresting everyone for everything, but there is a giant stack of policy that makes it very clear that arrest is an action of last resort. That is, it is preferable to issue a summons because it lessens any risk to the larger organisation by having people in custody. Like pregnant people.

Is it usual for the police officer who obtained the search warrant to not be the one to execute the warrant?

The Charter would be tested against the pandemic emergency laws and it would be found as a proportionate response, I think
Ballarat was also the scene for a previous uprising, as I recall, in which trooper’s featured (also),
I think the PR from this will ensure that the ‘faceless men’ are currently running behind the scene polls and looking at the calendar as to when it will be best for the replacement to enter the fray : Dan will need to ride-out these storms and the next glib leader will be able to distance themselves from “perhaps some decisions weren’t optimum, but mine is a different administration” : I’m thinking Xmas break will see Daniel wanting to spend more time with his family

  109. Knuckle Dragger

    Sal.

Having watched the original Blue Murder, starring Richard Roxburgh about a thousand times I feel qualified to comment.

And it depends on the type of warrant. Some, for certain classes of offence (weapons, firearms, stolen goods) specify the person named in the warrant, ie a particular walloper must be present AND formally execute the warrant, commencing the search. There is case law to say that this may be extended to any walloper at the joint, as long as the person named in the warrant is present.

Others, and the more common ones (in Vicco at least) with much broader definitions say the person named in the warrant must CAUSE the search to be carried out, seize stuff, bring villains before a court of competent jurisdiction etc. Which means whoever actually applied for the warrant doesn’t have to be there at all.

I suspect you’re looking for a cut and dried answer, sorry. This ain’t it.

Allegedly, apparently and according to rumour.

  110. I suspect you’re looking for a cut and dried answer, sorry. This ain’t it.

    No, just wondering.
Just that there’s nobody here (in my place tonight) who’s been on the receiving end of a search warrant without the officer who sought the warrant being present.

These things differ from state to state, heck from station to station (or presumably from oic to oic)

  111. And those names are … ?

Anyone can read ’em for ’emselves.
That said, what I’d do to those … people… would be far worse than doxxing.
(though there’s a bit of work to do on the first couple of letters of the surname of the one on the search warrant)

It’s not as if their names are any secret, they’ve been published on the internet this afternoon.

  112. Barry

Victoria’s Charter of Human Rights is not fit for purpose.

  113. Knuckle Dragger

This entire incitement charge is sooooo how’s your father. 321G of the Crimes Act 1958. This isn’t the wording of the legislation but from, ahem, stuff:

‘Inciting a person to pursue a course of conduct that will, if acted upon, involve the commission of an offence by the person incited and/or the inciter is an indictable offence (Crimes Act 1958 s321G).[1]
This is a form of inchoate liability, like attempt and conspiracy (see, e.g., Board of Trade v Owen [1957] AC 602).’

‘Incitement is an indictable offence, regardless of whether or not the incited offence is indictable (Crimes Act 1958 s321G).’ Note: I was wrong on this specific bit earlier today.

‘Incitement is a substantive offence, and is committed upon completion of the inciting conduct, regardless of whether the incitement is successful. This distinguishes incitement from accessorial liability (see, e.g., R v Massie [1999] 1 VR 542; Dimozantos v R (1993) 178 CLR 122).’

    ‘Incitement has two elements:
The accused incited a person to pursue a course of conduct that would, if acted upon, involve the commission of an offence (the “principal offence”); and
At the time of the inciting conduct, the accused intended that the principal offence would be committed.’

Leaving aside whether ‘the offence’ in question is a pile of shit or not, there might just be some argument to be had that a specific person had to be incited.

Not ‘loads of punters MAY be incited to go to the Rat Rally’ but ‘Person X was incited, directly by the actions of Zoe Lee to go to the Rat Rally.’

And the prosecution has to prove that to the requisite standard of proof, which is beyond a reasonable doubt. Which means they need a statement from Person X saying ‘well I wasn’t going to go to the Rat Rally but Zoe’s FB post convinced me. The hell with it.’ Or pinch Person X at the rally holding a sign that said ‘Zoe’s Post Made Me Turn Up.’

Man, I’ll be watching this. There’s a reason they bailed her to January next year, and that’s because certain people are hoping it will die down and be forgotten by then.

    Certain people might be disappointed.

  121. BrettW

Seems the Herald Sun article on this is not allowing comments. Perhaps they know that if they allowed comments they would not be favourable to the Police / Government and allow people to “incite” further protests. Not mentioned on the Oz so far.

No matter what your thoughts on the matter the use of handcuffs in this situation is over the top. Even if it was a male. She was not resisting physically. Not sure if it is policy for every arrest but if it is they better be consistent if any senior cops arrested in connection to Lawyer X (chances of that seems remote with the cosy relationship between police and Government in VIC).

From Herald Sun about Sam Newman.
Newman said the efficient officers were advising him against protesting which he assured them was never happening.

    Not always, but usual.

    KD.
I thought the sequence of events would be:-
    1. Serve the warrant, including explaining to the subject what the warrant was about;
    2. Conduct a search and possibly seizure;
    3. If necessary, arrest the person, including advising them of their legal rights.
Ms Zoe quite correctly called out one of the deadshits for barging through the house before the warrant was served. Meanwhile the clown with the paper went into full Kojak mode, reciting Miranda before he had served the search warrant properly.

The troops are out probably to scare the she-it out of everyone to divert from the big story. Old tactic. Andrews is also peddling his poo uphill for his malfeasance and people like him only know one way of dealing with their failure and that is to blame other people and clamp down even further. The guys and girls at the front are under orders. It is a sad, sad, time in Victoria. I put it down to the year of the rat ie Daniel Andrews and his Labor maates.

Both the male police are wearing black. So are they Detectives or uniformed officers who have changed clothes ? If they are Detectives both wearing full black shoes, trousers, and jackets seems not normal Detective wear. Are the trousers and jacket police issue as no apparent police badges or insignia on them. ?

But as we know black is an intimidating look so clearly a deliberate choice of clothes.

Well done VICPOL. Outstanding work. Those police might have 20 more years working in that community but Premier Dan will be retired soon and no doubt living off a very generous pension.

    The name on the warrant?
    I can’t make it out?
And the name of the flog at the house?
    Where is that from?

  218. Inncoherent Rambler:

twostix, methinks they will request early delivery of the rifles and skip the training.

You watch – Day 1 after issue, there will be coppers strutting around with these things like a rooster with his first hard on.

He’s the one on the warrant.
The name on the ID at the house is also mentioned there.

We need this as a part of a constitution that cannot be overridden in an “emergency”.

“Parliaments shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

  222. Fair Shake

So where was this flying squad when BLM protests organisers came along and fked Lockdown 1.0?

Jon Faine and Magda Zab… please tell us what to do …you fking dingbats.

[Love your work Econocrat – that post might cause a lot of trouble. I have taken a screenshot and will restore it when this person is arrested and prosecuted. Sinc]

Winston bails it. The clip represents, as people here and elsewhere are all recognizing, Everywoman. That’s everyone’s pregnant wife or daughter there, and their menfolk are angry and so are their wives.

I hope you are right, but I doubt it going by the majority response on FB.

    Like these,

If she’s so concerned about her pregnancy, why on Earth was she going to a protest?! Stupid woman!

dafuck?? No but you lose your rights to break the law. It’s ok to protest but you have to do what the BLM and all the other protestors have to do and make an application to the courts. Otherwise it is incitement

Hey Vic Pol! I thought your motto was “Uphold the Right” … when did it change to “Uphold the (Socialist) Left”?

Hope you are ashamed of yourselves!

Mark A where are you getting your 80:20 from?
I am not seeing anything but “furious anger” at the VikPlod goons.

Dan ain’t afraid of the people.

Why doesn’t he ever hold a mass public rally, then?

    He’s afraid, don’t worry.
