  23. egg_ says:

Bush v. Gore was the culmination of numerous lawsuits triggered by the close vote in Florida. After both campaigns filed lawsuits in various state courts, the Florida Supreme Court decided to extend the hand-counting of votes until Nov. 26, 2000, eight days after the state’s statutory deadline for certifying the election results to Congress. The Bush campaign challenged that decision in the U.S. Supreme Court.

In a 5-4 opinion, the Supreme Court ruled that the mandated recount ordered by the Florida Supreme Court violated the equal protection clause.

The Supreme Court reasoned that the failure of Florida courts to establish a uniform standard for determining legal from illegal votes in a recount created the possibility of different standards being used by different counties. The court concluded that this was a violation of 14th Amendment rights to due process and equal protection of the law.

The justices who voted to grant the stay were Chief Justice William H. Rehnquist and his four conservative colleagues: Justices Sandra Day O’Connor, Antonin Scalia, Anthony M. Kennedy and Clarence Thomas.

The dissenters were the court’s four most liberal members: Justices John Paul Stevens, David H. Souter, Ruth Bader Ginsburg and Stephen G. Breyer.

Ginsburg was a grub until her very last gasp – thought she was some sort of deity, and so did her successors. They worshiped her just as the dissolute degenerate Edward Kennedy was worshiped for the forty years after he abandoned Mary Jo Kopechne to die, which is one of the reasons I have no trust for her successors Kavanaugh and Barrett. She took the backhanders and did as she was told, as will they.

One does not achieve high public office in the USA without seeking and accepting the graft en route. Kennedy and Ginsberg set the standard to be achieved.

  58. Colonel Crispin Berka says:

Further to the helpful talking point timecode index of Viva Frei Ep. 37 contributed by helpful commentator egg_ , another interesting thing Barnes says at 1:45:54 is…
The Constitution has a safe harbour deadline that works like a timeout, where the power to appoint EC electors reverts automatically to the federal House of Representatives if any litigation about the popular poll has not resolved. If the SCOTUS gets involved in any way that slows down the election court cases, they will in effect force this congressional contingent election method indirectly. (Which Trump probably wins)

I figure that means SCOTUS taking a long time to deliberate could be Trump’s best chance. The formula for SCOTUS therefore is:
    Fourscore beers 4 more years.

Bush lawyer turns up with his head up his arse as usual. The complaint could have had the 10 missing Commandments and the solution to the Riemann hypothesis and the judge would not have cared; the evidence was never tested because bratt said they had no standing and the equal protection principle did not apply, both fallacious.

  66. Ƶĩppʯ (ȊꞪꞨV) says:

The day after a group run by a local Ohio tea party leader took out a full-page ad in the Washington Times calling on Trump to declare martial law and have the military oversee a redo of the presidential election using only paper ballots — a call echoed in a tweet by Gen. Michael Flynn — a raucous “Stop the Steal” rally in suburban Atlanta urged Trump supporters to descend on the statehouse on Thursday and demand the resignations of Georgia’s governor and secretary of state. In a press release announcing the ad published Tuesday by We the People Convention, the group’s president, Tom Zawistowski, said, “We wanted to express our concerns to the President, to the legislators, courts and Congress that We the People will NOT cede our exclusive Constitutional right to elect our Representatives to judges, lawyers, courts, Governors, Secretary’s of State, Congress, corrupt election officials and local politicians, the corrupt media — or Leftist threats of violence!”

  67. Armadillo says:

“Trust” is the biggest issue going forward. You can’t build any sort of relationship without it. Personal, business or political.

  68. Colonel Crispin Berka says:

calling on Trump to declare martial law and have the military oversee a redo of the presidential election

There are still civil Constitutional remedies. Marshal law is unnecessary, authoritarian, looks very bad, counterproductive in the long run, probably opposed by the Pentagon anyway, and so is insane to even suggest it.

This does not seem to be helpful to the Republicans as must win Georgia Senate seats :

Former Trump campaign attorney Sidney Powell told supporters at a Wednesday rally in Alpharetta, Georgia, to boycott state elections until she deems voting systems “secure.”
Powell has filed a legal challenge to the election result in Georgia, baselessly alleging a vast conspiracy to subvert the election by Venezuelan communists using fixed voting machines.
She did not mention the state’s January 2021 Senate runoff vote in her speech, but if Republicans follow her advice in that election, GOP turnout could be depressed.
Georgia Republicans worry that attacks by Trump and his allies on the state’s officials and voting systems will actually endanger their chances of winning the runoffs and retaining control of the Senate.
At the Wednesday rally, pro-Trump attorney Lin Wood also interrupted a state representative who urged supporters to vote in January, with the lawyer telling them to stay home instead.

Lin Wood, the charismatic though increasingly off-the-wall celebrity lawyer, has spent the past few weeks making wild accusations that the election in his state was corrupted and should be rewarded to Trump. On Wednesday, he took it a step further, encouraging Republicans to boycott the upcoming Senate runoff elections unless the governor—Republican Brian Kemp—called a special legislative session to investigate the supposed conspiracies of wrongdoing.

That seemed to be a bridge too far for members of the president’s team, which quickly came to realize that the genie they let out the bottle was angling to poison their party.

“Anyone who cares about the future of our country needs to ignore the fools and support President Trump by voting for Republicans in the Georgia elections,” one senior Trump aide told The Daily Beast. “Many of us think Lin Wood is actively working against our mission to elect President Trump’s allies in Georgia. He said so himself.”

    Republicans in disarray!

In both cases, I’m trusting the courts. I trusted the court to consider all of Pell’s accusers testimony (which we weren’t privy to), and those of Pell’s witnesses. Which is why I never took a personal position on whether he was guilty or not.

I’m beginning to think you really are stupid bush lawyer. Evidence is affidavits, expert testimony, forensic evidence such as film of ballots appearing and being falsified etc; legal process is applying legal criteria to evidence after evidence has been presented or BEFORE it has been presented and whether it can be presented such as establishing whether a litigant with evidence has standing to present the evidence or whether a fundamental legal right to present evidence such as the equal protection principle applies. Bratty did not look at evidence because he decided Trump had no right to present evidence because he had no standing and the equal protection clause did not apply, both of which were erroneous.

The lawyer goes wide and starts arguing from general history that mistakes always happen in elections! I don’t recall him making a specific counterclaim about that election in that county!
