    This is such an arse-about way of looking at it. The doctrine of standing prevents activist judges from creating law without context. I am old enough to remember when you lot whined incessantly about activist judges. Now you’re all on their side, because they’re reactionary activist judges who want to blow up small-l liberal laws.

    Barnes is correct to the extent of arguing that the principles governing the standing of persons to seek relief from US federal courts has been crafted by the Supreme Court. The legal basis for this doctrine are vague words in Article III of the Constitution (and similarly in Australia). Only to this very limited extent are the principles “imposed” on the courts.

    It would seem that no harm follows from an attempt by any citizen to seek to have unlawful action by any branch of the government corrected. But what government can or can’t do cannot be subject to constant resort to the courts and judicial decisions. The moreso where the decisions must be based on some inarticulated premise (because in very many instances the apparently legal principles cannot by themselves direct a clear answer).

    The context in which the standing principles are invoked is critical. Where it is the very integrity of the Presidency, the argument for a judicial resolution is very strong.

    The courts have this usurpation going which is called “lack of standing.” They throw things out due to “lack of standing.” There is no sound legal theory backing this up. Its just an usurpation that I now understand (thanks to Mr Barnes) got going somewhere around the 1920’s. Its nonsense of course. Its just the legal crowd getting uppity. But for practical purposes it delays the revelation to the colour revolution being attempted by the usual players.

    Lack of standing is integral to common law. It means that busybodies do not get to use the law in matters that have nothing to do with them.

    Unfortunately, it has not been applied sufficiently to activists from other States who lodge actions against the Adani coal mine, for example.

    Well, that’s one way of putting it, Monty.
    Another would be to say legal standing exists to protect the rights of those with legitimate grievances whose status at law might otherwise be diluted were they indistinguishable from vexatious cranks.

    The rules developed to govern the ‘doctrine’ are pretty straightforward and Trump’s standing – pursuant to them – is undeniable.

    Judges nominally are restricted by 2 things: precedent and the legal source, in the US and Australia a constitution. The reference to the constitution applies the principle of ultra vires; ultra vires means a law is made without the legal authority of the source. This is not the same as a criminal act although it can lead to criminal acts. Courts apply ultra vires in judicial reviews of government laws and regulations to see if those pollies and bureaucrats have acted within their authority. Sometimes courts are also subject to ultra vires scrutiny. In PA for instance the PA courts alteration of constitutionally dictated methods of ballot counting which contributed to joe’s win were clearly ultra vires as the constitution gives the power to do that to only the legislature. That is one reason the appeal to SCOTUS will succeed.

    Pennsylvania Supreme Court Plays Politics

    In a unusual decision, the Pennsylvania Supreme Court invoked the ancient doctrine of “laches” to toss GOP Congressman’s Mike Kelly, congressional hopeful Sean Parnell, and six other GOP candidates’ lawsuit against the state.

    Laches is a legal defense that stops a plaintiff from recovery because the plaintiff was too slow and careless in bringing his lawsuit.

    A ruling from a lower court earlier week this barred the state from taking any further action to certify its election results pending a hearing on the in Kelly case.

    But today, the Pennsylvania Supreme Court ruled Congressman Kelly should have filed his lawsuit shortly after passage of Act 77, which vastly expanded the mail-in balloting to let all qualified voters to vote by mail without an excuse. Congressman Kelly filed suit after the election and argued Act 77 wrongfully overrode the stipulations for absentee balloting established by the state’s constitution.

    In essence, the court told Kelly and Parnell they were too late — that they should have filed the suit well in advance of the election.

    But one requirement in brining a constitutional claim is an “injury-in fact.” That means the plaintiff needs to show he has or will suffer a harm and the injury must be concrete. If Congressman Kelly had brought his suit before the election, the court could have easily (and likely would have) dismissed Kelly’s claim on the grounds that he had not suffered an injury yet.

    The Pennsylvania Supreme Court is playing politics. The Kelly case is excepted to be appealed to the US Supreme Court for final resolution.

    Barnes argued that once January 21 came and passed, that would be the end of legal controversy. Perhaps it may not. It is not uncommon that a legal system cannot provide an answer to a problem calling for one. In the aftermath of the Civil War, the US courts had to deal with the problems thrown up by the fact that the legal relations of various kinds had been altered by laws made by the Confederate States that were illegal in terms of the now restored federal Constitution. Were the Confederate laws to ignored? The answer was ‘no’, and to justify this answer a doctrine of ‘necessity’ was invoked. (As has occurred in other legal systems, and I know if one Australian administrative law case where it was used to justify a major departure from the rule that a decision-maker should not be biased.)

    So, maybe, were the Supreme Court to find that the integrity of the elections to be compromised such that the next President would lack legitimacy, it might, invoking necessity, make an order that the inauguration not proceed and consequential orders as to how the situation could be remedied. To be effective, perhaps the military would need to make it clear that it stood behind the Court.

    All this sounds extreme, and amounts to a break and restart if the Constitution. But the gravity of the problem – which is not yet clear – may require such a course if action.

    The money was sent through agreements that had municipalities run elections in contravention to state law, according to the lawsuits, which were filed by the Thomas More Foundation’s Amistad Project. Accepting funding from a private group like the center is barred by state and federal law, the lawsuits allege.

    “There is nothing in Wisconsin state law that allows cities and counties to take in millions of dollars sourced to an incredibly wealthy, interested, and partisan actor (i.e., Zuckerberg) in order to ‘assist’ those cities and counties in administering the vote,” the Wisconsin court filing states. Wisconsin election officials said on Friday that filing was full of “meritless legal arguments.”

    In the Georgia filing, the Amistad Project says the unregulated private funds from the Center for Tech and Civic Life were used to pay “ballot harvesters,” deputize and pay political activists to manage ballots, and consolidate counting centers in the urban core “to facilitate the movement of hundreds of thousands of questionable ballots in secrecy without legally required bi-partisan observation.”

    Ok – on second thoughts, this bunch of voters may not be part of the Demo-steal.

    Many people in the US receive their mail through drop-boxes while travelling, or moving around frequently. So they may have just used the same method to register to vote.

    It does, however, make all those votes invalid.

To obtain the Court’s review, Parnell and the other voters must show that the Pennsylvania Supreme Court’s decision somehow violates federal law. While the Pennsylvania Supreme Court’s decision is rooted in state law, a good argument can be made that it involves a federal question.

    In interpreting the legislative power within the context of selecting Presidential Electors, the Supreme Court of the United States has held, “What is forbidden or required to be done by a state is forbidden or required of the legislative power under the state constitutions as they exist.” McPherson v. Blacker, 146 U.S. 1, 25 (1892). In other words, the “legislative power” to select Presidential Electors includes those limitations that state constitutions place on its legislatures—in this case, the Pennsylvania state constitution’s limiting of absentee voting to the above five situations. This may constitute a viable federal question for the Supreme Court of the United States to intervene. And while McPherson dates from 1892, its rationale is sound, and the Court has cited it as recently as 2015. See Ariz. State Legislature v. Ariz. Indep. Redistricting Comm’n, 576 U.S. 787, 839 (2015).

    The other question is what weight, if any, the Supreme Court of the United States will give to Parnell’s supposed delay in bringing the lawsuit. I will admit that this is an area I have not examined much, and so I will refrain from commenting on it for the time being. But this much, at least, seems clear to me: the Pennsylvania mail-in voting law is unconstitutional.

    Gunner, the problem with these voting machines is they are both printers and scanners in the same paper path. Therefore it is possible to feed in a blank ballot and register a vote for whoever you want, with a nicely printed physical ballot to add into the heap. The internal logs on these machines were often disabled or else erased soon after the event. Logging is considered an optional extra, not a legal requirement. The only thing preventing this kind of activity would be oversight from election scrutineers and those people were kicked out in the evening after the election.

    With the Trump campaign turning from the courts to the legislatures, Pennsylvania state Rep. Greg Rothman, R-Cumberland County, is taking the baton to call for a state review of the contested election.

    “It’s indisputable that hundreds of thousands of vote-by-mail ballots [were counted] without anybody from the Trump campaign or the Republican party being able to observe,” he concluded.
